Insurance Litigation

You purchased insurance for your property to protect you in the event of costly damage to your home. The 5 Basic Estate Planning Documents
Planning for your estate is a crucial step to protect yourself, your loved ones, and your future. Estate planning can cover sophisticated trust, tax, and estate planning, but each estate plan, at a minimum, should contain these five documents:
Last Will and Testament
A will outlines how your assets should be distributed after your death and allows you to name a personal representative (executor) to handle your estate. If you have minor children, your will can also designate a guardian for them. Without a will, state law and the state decide who inherits your assets.
Durable Power of Attorney (POA)
A POA gives someone you trust the authority to manage your financial and legal affairs if you become incapacitated. This document can help avoid the need for a court-appointed guardianship and ensures your bills, taxes, and other financial matters are handled without delay.
Designation of Health Care Surrogate 
This document allows you to appoint someone to make medical decisions on your behalf if you’re unable to do so. Without it, your family may have to go to court to gain decision-making authority, delaying critical medical care.
Living Will
A living will expresses your wishes regarding end-of-life medical treatment, such as life support and artificial hydration. It helps guide doctors and loved ones in making difficult decisions if you’re in a terminal or vegetative state.
Pre-Need Guardian Designation
This document lets you choose who should be appointed as your guardian if you become legally incapacitated. It can prevent family disputes and ensure that someone you trust is in charge of your care.

Joseph Bendel, Esq.


Joseph brings over a decade of legal experience to his practice where he assists clients in navigating the legal system. He gets up each morning with a singular purpose: to aid his clients in finding solutions to challenging legal issues. In a landscape where clients often find themselves grappling with a complicated legal system, he is dedicated to providing clarity and support every step of the way.


Joseph began his legal career by serving the South Florida community at the University of Miami School of Law. He served as a member of the Health and Elder Law Clinic (now the Health Law Clinic) where he represented clients who could not otherwise afford an attorney in Social Security administrative and immigration cases. He extended his commitment to community service as a member of the Investor Rights Clinic, advocating for members of the investment community with claims against their brokers. He furthered his expertise by obtaining a Masters of Law (LL.M.) in Taxation from the University of Miami School of Law. He graduated from the University of Miami School of Law cum laude


Joseph gained extensive experience in both estate planning and litigation, representing clients in state and federal courts. He is qualified to appear in both the Southern and Middle District Courts of Florida. He founded Bendel Law with the mission of providing accessible legal services to the South Florida community. He is dedicated to finding strategic solutions for his clients' problems and seeks to have clients leave his office better off than when they first arrived. He places a strong emphasis on ensuring his clients' peace of mind in every matter he handles.


Joseph is originally from Canada and is an avid ice hockey player. During his time playing in South Florida, he has had the pleasure of sharing the ice with many current and former NHL players. He enjoys the outdoors and all they have to offer. In 2015, he summited Mt. Shuksan (9,131 ft) in Washington state. Prior to becoming a lawyer he was an Emergency Medical Technician and a teacher. More than ice hockey and the outdoors, he enjoys spending time with his three children and his wife, Carolina.
